These Terms & Conditions ("Terms") govern your use of the AllCharge mobile application on Android and iOS (the "App"), our website and any related services (together, the "Services"), operated by ALLCHARGEX PRIVATE LIMITED ("AllCharge", "we", "us" or "our"), a company incorporated in India.
By creating an account, joining our waitlist or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
1. About the Services
AllCharge is an aggregator platform. The App helps you discover electric vehicle ("EV") charging stations across multiple charging networks, view availability and pricing where available, start and stop charging sessions, and pay for those sessions through a single account.
We do not own, operate or maintain the charging stations listed in the App unless expressly stated. Charging stations are owned and operated by third-party charge point operators ("Charging Partners").
2. Eligibility
You must be at least 18 years old and capable of entering into a binding contract under Indian law to use the Services. By using the Services you confirm that the information you provide is accurate and that you will keep it up to date.
3. Your account
- You need an account to start charging sessions. You are responsible for keeping your login credentials, including any one-time password (OTP), confidential.
- You are responsible for all activity that takes place through your account. Tell us immediately if you suspect unauthorised use.
- One person may hold one account. Accounts are personal to you and may not be transferred or shared.
- You may delete your account at any time as described in our Privacy Policy.
4. Charging sessions
- Station details in the App, including availability, connector types, power ratings and pricing, are provided by Charging Partners. We work to keep this information accurate but cannot guarantee it is complete or current at all times.
- You are responsible for checking that a charger is compatible with your vehicle before starting a session.
- A session may end, or fail to start, for reasons outside our control, such as charger faults, network outages, power cuts or the Charging Partner's own systems.
- You must follow all instructions displayed at the charging station and any applicable site rules, including parking rules and time limits set by the site owner.
5. Third-party charging networks
When you charge at a Charging Partner's station, that Charging Partner is responsible for the equipment, the electricity supplied and the safety and condition of its site. Their own terms may also apply to your use of their stations. We are not responsible for the acts or omissions of Charging Partners, including station downtime, incorrect pricing displayed at the station, or damage occurring at their sites.
6. Wallet, pricing and payments
- Wallet: the App may provide a prepaid wallet you can top up to pay for charging sessions. Wallet balances are for use within the Services only, carry no interest, and are not a deposit or a payment instrument issued by us.
- Pricing: charging is billed on the basis shown in the App before you start a session, which may be per unit of energy (kWh), per minute, or a session fee, plus any applicable platform fee, parking charge or taxes including GST.
- Payments: payments are processed by third-party payment gateways. We do not store your full card number, CVV or UPI PIN. Your payment provider's terms apply to the transaction.
- Final amount: the amount charged at the end of a session is based on the energy delivered or time elapsed as reported by the charger, which may differ from any estimate shown at the start.
- Price changes: prices set by Charging Partners may change without notice. The price shown when you start a session is the price that applies to that session.
7. Refunds and failed sessions
If a session fails to start, stops early or you are charged incorrectly, contact us with the session details and we will investigate with the Charging Partner. Where a refund is due, we will credit it to your AllCharge wallet or to your original payment method. Refunds to a payment method are subject to processing timelines set by your bank or payment provider. Wallet top-ups are generally non-refundable except where required by law or where we determine a refund is appropriate.
8. Acceptable use
You agree not to:
- Use the Services for any unlawful, fraudulent or abusive purpose.
- Interfere with, damage, tamper with or attempt to bypass any charging station, meter or payment mechanism.
- Use another person's account, payment instrument or vehicle credentials without authorisation.
- Copy, scrape, reverse engineer, decompile or attempt to extract the source code of the Services, or access them through automated means without our written permission.
- Upload or transmit malicious code, or attempt to gain unauthorised access to our systems or data.
- Resell, sublicense or commercially exploit the Services without our written consent.
9. Safety and your vehicle
You are responsible for the safe charging of your vehicle, including using undamaged cables and connectors, following your vehicle manufacturer's instructions, and complying with safety notices at the site. Stop charging and report the issue if you notice damage, overheating, sparks, exposed wiring or any other hazard. We are not liable for damage to your vehicle or battery arising from the condition of a charger, the quality of electricity supplied by a Charging Partner, or your failure to follow manufacturer or site instructions.
10. Intellectual property
The Services, including the AllCharge name, logo, app design, text, graphics and software, are owned by ALLCHARGEX PRIVATE LIMITED or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the App for your own, non-commercial use of the Services. All other rights are reserved. Third-party names and logos shown in the App, including those of Charging Partners and app stores, belong to their respective owners.
11. Service availability
We aim to keep the Services available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any feature, or perform maintenance, at any time. Features described on our website or waitlist communications are indicative and may change before or after launch.
12. Limitation of liability
To the maximum extent permitted by law:
- The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied.
- We are not liable for indirect, incidental, special, consequential or punitive losses, or for loss of profit, revenue, data, goodwill or business opportunity, arising out of your use of the Services.
- Our total liability for any claim relating to the Services is limited to the greater of (a) the total amounts you paid to us through the Services in the three months before the event giving rise to the claim, or (b) ₹1,000.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence or for fraud.
13. Indemnity
You agree to indemnify and hold harmless ALLCHARGEX PRIVATE LIMITED, its directors, employees and agents from any claim, loss, liability, cost or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.
14. Suspension and termination
We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe you have breached these Terms, used the Services fraudulently or unlawfully, or created a risk to other users, Charging Partners or our systems. You may stop using the Services and delete your account at any time. On termination, amounts already owed remain payable, and we may retain records as described in our Privacy Policy.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the App, by email or by updating the "Last updated" date above. Continued use of the Services after the changes take effect means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of India. Subject to the paragraph below, the courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.
Before starting any formal proceedings, please contact us so we can try to resolve the matter informally. You may also raise a grievance with our Grievance Officer, whose details are below.
